Facility of the Year (FOYA) Logo Use Policy
The Facility of the Year (FOYA) Awards Program logos (hereafter referred to as "logo") may not be used to imply or suggest endorsement of any product, person, property, or service not provided by ISPE, INTERPHEX, or Pharmaceutical Processing magazine (hereafter referred to as "Sponsors") in conjunction with the Facility of the Year Awards Program. The FOYA logo and name are registered and protected by law and restricted for use as licensed by the Sponsors.
Winners (Manufacturers)
Category and Overall FOYA Winners are permitted to use the respective FOYA logo that correctly and accurately depicts their status at a Winner for that category and year on organization materials such as, but not limited to, corporate stationery, business cards, advertisements, brochures, equipment, giveaways, banners, and advertising materials, or other property, only as these items relate to the organization, and not as to any individual person or entity other than the Category or Overall Winner. Use of a FOYA logo by a Category or Overall Winner must relate that organization to the specific category that the organization has won for that year. Category Winners may only use the respective FOYA logo that relates to that category, and logos may not be used by any organization other than that which won that category. Overall FOYA Award Winners may use the category logo or the Overall Winner logo at their discretion.
Category Winners and Overall Winners may opt to state their status as a Winner in wording form without the use of a logo. Regardless of logo or word use, the year in which the recognition was received must be included. For example, "VETTER PHARMA-FERTIGUNG GMBH & CO. KG - Facility of the Year 2007 Award Winner in Process Innovation" FOYA Committee approval is required for any other type of use. FOYA logo and verbiage use is restricted to those Manufacturers that have been named a FOYA Category Winner or Overall Award Winner.
Suppliers to Winners
Suppliers to Category or Overall Winners may utilize those only specific "Supplier" FOYA logos that relate to the category and year won by the Manufacturer that won that award, and only if the Supplier has been identified by the Manufacturer as a Supplier in relation to that winning project. Suppliers should follow the graphic standards set forth by this policy. Specific logos will be created by Sponsors for Suppliers based on the Winner's FOYA logo; these logos may not be altered, modified or changed in any way.
As above, Suppliers may opt to state their status as a Supplier to a FOYA Category or Overall Winner in wording form without the use of a logo. Regardless of logo or word use, the year in which the recognition was received must be included. For example, "Official Supplier to VETTER PHARMAFERTIGUNG GMBH & CO. KG - Facility of the Year 2007 Award Winner in Process Innovation" FOYA Committee approval is required for any other type of use. FOYA logo and verbiage use is restricted to those Suppliers that have been named by a FOYA Category Winner or Overall Award Winner as an Official Supplier to that winning project.
Logo Use on Company Web Sites
Use of the FOYA logo on company Web sites is restricted to links leading to www.facilityoftheyear.org. Use of the logo for this purpose is subject to Sponsor review and approval. Web sites must be submitted for approval to Sponsors. The use of the FOYA logo on a company's Web site should not be construed in any manner, way, shape, or form as an endorsement of the company by FOYA or the Sponsors.
Logo Protection
FOYA logos, including but not limited to words, fonts, graphic elements, colors, and spacing, may not be altered, modified, changed in any way, or used as separate elements in any application. Sufficient white space or separation must be used so as to completely and clearly avoid any association with any other logo, organization, product, person, property, or service. Determination of sufficient separation will be at the sole discretion of the Sponsors, which will not be unreasonably withheld.
Actions
Sponsors reserve the right to withhold, restrict or curtail use of a FOYA logo or name should this Policy be violated. If a company or individual violates this Policy and uses the FOYA logo or name without permission the following actions will be taken by Sponsors:
- A cease and desist letter will be issued to the individual or entity stating that he/she/it is not in compliance with the FOYA Logo Policy.
- If a violator does not follow the first cease and desist letter, Sponsors' attorney will issue a second letter.
- If a violator does not cease and desist, Sponsors reserve the right to pursue legal action.
